Gift of money by cheque - affidavit to notary will suffice

Can anybody please help if somebody gift some money to his brother within the blood relation whether an affidavit is required to submit by the donor? If yes and if it is made to notary will it serve the purpose or it is to be submitted before an executive magistrate? Pls. help.
