Hi,
I have been working for a firm in Blr. I and few of my colleagues joined this firm in Apr 2011. Since then the company has not been paid salary. we were deployed at Mum and not paid salary since employment. Please advice on the same and future course of action.
Also, the employer is threatening civil or criminal actions cause we have been following up with him since last 2 months.
Plz advice

Dear, No body can take work from any one without paying for the same. Give a legal notice to the employer for payment of your salary. You also , have to move to Labour Court immediately for payment of your salary as it seems your employer does not want to make payment.

The company can not force you to work for the company without paying the salary.
You just send them a letter demanding salary arrears. If they dont pay the salary in time, you just quit the job and join in any other company. They can not initiate any against you.
Check the credibility of the company, with any Human Resources consultants, and then join.

For the past 4 months the company is not making any payment towards your salary. Having extracted the work the company is supposed to pay the salary. When asked the company is threatening. The company can not do anything or take any sort of action against you. I do not think the company will the salaries in the coming months also. Hence, it is a good idea to quit the job and join elsewhere. Regarding arrears of salary file petition in the court, if you want to do so.

I have an appointment letter stating my designation , place of deployment and also the salary to be paid annually with the break up per month & annual basis.
We have been following up for the salary and the employer has threatened legal action and also claims that there has been no work done since last 2 - 3 months so salary will not be paid.
