Q.Gardenia Shelters Pvt Ltd Noida given possession of flat in violation of rule without taking clearance certificate from Noida Development Authority. The Realtor failed to execute agreement with the Buyer before giving possession. A month after possession, agreement was executed. Realtor states that as per the agreement, single man arbitration only can be done and therefore my complaint in New Delhi Consumer Court to be dismissed, it was contended/argued by the Realtor.
(a)Whether Agreement executed after possession is valid or not?
(b)Am I forbidden to file complaint in Consumer Forum?
(c)Whether Supreme Court ordered in 2005 Realtor comes under Consumer Act and if so, salient features of the same may kindly be furnished.

The agreement and other documents has to be referred, Consult a local lawyer and show him all the papers.
