the property not gifted by the govt. to the sc/st. he has taken loan from sbi and defaulted repaying loan. now being general category i want to purchase through auction. can i go for purchasing?

Dear Mr. Ajeet Kumar,

1. Yes, you can. The assured creditors can do so despite the fact that such land was unlawfully mortgaged to the bank by the decree debtors.

2. U/s 13(4) the S.A.R.F.A E.S.I. Act, 2002, the secured creditors can auction such land with the consent of the District Magistrate.
