Right of grandmother

Sir,
i have a property which belongs to my grandmother in 2004 but in 2005 my grandmother transfer and sell the property to my father's name. My father construct the property in 4 floors and made in will in 2011 stating after my death ground floor belong to his wife (My mother), 1st floor belongs to 1st son and 3 rd floor belongs to 2nd son and 2 floor sold to other. now my father expired in 2012.now my grandmother asked for his share in the same property. i want to know does she have the ledge rights to ask his for share in the same property when she is have 3 sons out of which 1 elder son my fater was passed away in 2012.

Dear Diwakar Verma,
1. Well, the grandmother had sold the property to your father. Your father made a Will and gave each of his sons a separate floor to live.
2. Now that your father is dead your grandmother needs to be taken care of. It is not that she wants a share but social security. This is what is understand.

Your grand mother has share in the property of your father. No portion of the house belong to your father after he expired, claim of your grand mother would not succeed. However, she can claim share in any other property of your father which was not bequeathed.

Agreed with expert Mr.Rajendra K Goyal. Since she sold the property to your father and your father after developing the property left will and died, the property goes to the persons named in the Will. You or your grand mother cannot do anything as far as that property is concerned, as it is treated as self-acquired property of your father and he has every right to dispose-off the property as per his wish.
If your deceased father has any other properties, his mother (your grand mother) and you (being his daugther) have rights in that property and can claim your shares as per law.

The experts have properly advised that since the entire property of your father was bequeathed by him as per his will, your grandmother will not find a share in the property which was fully settled during his life time by your father.
