Hi, i am Indian citizen and my husband has acquired australian citizenship (before he was also indian). My baby was born in Australia and that's why she is also Australian. But we've been living in India for more than a year now.
Here, i want to know if we go for divorce,can i contest for child custody. What are the chances for me. She is just under 4 yrs.
Secondly, if her nationality is a problem to get me my baby, what is the process of making her citizen of india like me, of course, without my husband's consent.
please advice.

You can file an application for custody of child in a District Court where you are residing now and you can submit an application to the ministry of home affairs for registration for citizenship of your child.

Should the application for custody go after filing for divorce and maintainace. and if i start working, can i also ask for my maintainance separately.Normaly, how long will the whole process take.
