Alteration of charges u/s 209, 216, 323 crpc

The charge sheet has been submitted by police u/s 336,337,338 for grevious hurt and case was in trial phase of final argument. During this time with the death of injured caused a new charge on accused to fall in IPC 304-II, 308, 328.

I have filed an application before magistrate to admit application for alter charges and transfer case for session trial. If by any reason my application rejects, what are my options to go further to make sure that this applications gets admitted and case gets transferred for session trial....Please guide.....many thanks

You can challenge this order in sessions court or in high court.

Move to High Court against the orders of the session court.
