Sue a company

Respected Sirs,
I had purchased a home appliance (refrigerator) from an international brand. Its been 2 years now and found a fault

for which i called their customer care and confirmed a service call for the next day. (PS: My younger sister is staying there and is getting very difficult.) I am now staying in a different city but due to personal reasons, I am required to be there for this work. hence I specially went there to take care of this. I waited for their call, but no one turned up and no call. I again called and they said it would be taken care of within 2 hours. Again no one turned up. I again called and called and everytime its a different person on the Customercare with the same reply. The entire day no one came with me just waiting idle at home. I expected the service another day but still no one turned up (perhaps because it was sunday) but they had said it would be done. Still nothing happened. Another day after a lot of calls, it seemed positive and someone from the service center came up for a minute and said we will have to take it to the workshop and the owner said it will take 4-5 days. I had to take a day off for which I got myself into a problem at my office. And the service center people came down to take the product after a lot of calls "again" and that too with a very unprofessional approach. They denied to give an estimate for the service charge. They said the supervisor will call me. After three days, i called back to confirm as I again would have to travel for the special "cause". They said they have yet not started the repair work due to some reason. The owner also told its not done giving a second reason. Totally upset and have gone through a lot of mental irritation.
I used social network for customer support. They apologized and said it would be taken care of shortly but after hours now still no call!
I am really really very much upset.
Can I sue this company and if yes, how?

Yes you can approch a local advocate and send the legal notice

It is a case of feficiency in service for which you can file a case in the consumer forum. Ask for adequate compensation from the company.

But, at first give notice, as already advised by Shri Sankar Narayanan. If there is a manufacturing defect the company should replace even your fridge.

In the long story of annoyance and irritation you have forgotten to state what was the warranty period undertaken at the time of sale by the vendor, warranty card with you would speak itself.If the Warranty was for 01 year,then product bought two years before would NOT make you able to sue and service and replacement would be on your cost.

Otherwise if warranty undertaken holds good till date of complain made to them,there reluctance would confer a cause of action to sue them in consumer forum of the district where purchase was made after service of notice on them.

Dear Singh Sir, The warranty is 1 year for entire product and 5 years on the compressor. I am ready to pay for the service charge but my main trouble is their lethargy and false promise of quality service that they say would be made within 24 hours.

If you want to sue the company, just keep noting date with time of your calls/ online requests and the nature of their response.

Even a Legal notice should be enough to solve ur pbl

Send legal notice to the company. If no result, may file complaint in consumer forum.
