Want file a suit under u/s 138 ni act

Hi All, i want to file a suit for dishonour of cheque that is also 2 times but it has crossed the said time limit, actually we tried to solve it on mutual understanding but failed now can anyone give me solution for this, I have lost Rs. 80000/- paid to owner of a house as a Security Deposit, now he is returning it back....please suggest

You cannot file case u/s 138 of NI Act. You will have to file a suit for recovery of money.
