Removing a party from multi-party suit

(Querist) 15 October 2012 This query is : Resolved 
There are three defendants in my suit. I am the plaintiff. I want to remove one defendant and carry on suing the other two. How can I apply for the same? I have already filed evidence and witness list.

You can file petition under Order 1 Rule 10 of CPC ta any point of time to remove the name of any of the defendants.

You can delete the one of the defendants by filing an application u/o 1 r 10 of CPC or you can also file a memo stating that you have no claim against the defendant No :
