Clubbing of cc and fir

My sister filed a FIR against me on charges of forgery and the chargesheet was filed. Exactly same allegations were made against me by my brother in a complaint case and summons were issued to me. I want to know whether these CC and FIR can be club together. All the accused and the witnesses are the same?

No you can not as the complainants are different persons.

Dear Mr.Kumar,

In such scenario - the court in the complaint case is obliged to follow the procedure as laid down in S.210 CrPC. It has to keep complaint proceedings in suspended animation and call for a report of Police Report Case - and on reciept of same if the court is satisfied that they pertain to the same transaction - both are tried together by the court in Police Report Case as if both arose out of a police report. Otherwise both go on seperately.
