Dear Sir,
I Am K.MUTHUKUMARAN S/O G.KUPPAN.
MY FATHER WORKED AS ASSISTANT INSPECTOR OF LABOUR IN TAMILNADU GOVERNMENT.HE PASSED AWAY IN 2008 DUE TO HEART ATTACK WHILE IN SERVICE..I APPLIED FOR COMPASSIONATE APPOINTMENT IN TN GOVERNMENT..MY EDUCATIONAL QUALIFICATION IS B.TECH[IT].WOULD I GET JOB RELATED TO MY EDUCATION PROFILE..
IS THERE ANY SPECIAL PREVILAGES IN COMPASSIONATE APPOINTMENT FOR PROFESSIONAL COURSES[B.E/B.TECH/B.ARCH/MBBS]
KINDLY HELP ME IN THIS REGARD..

The best of sympathy with you family will not compel me to give a wrong advise to lead you to litigation expenses out of badly depleted resources. Prima-facie the compassionate job is not enforceable right.
No you are not getting the job as per your qualification. All the authorities have to see whether you are metric or not. If you are metric then can be considered for clerical job. You are not getting compassionate job above Gp-C if the job of clerk/accountant is not vacant you can be offered the job of peon/ driver/ Gardner/ sweeper/ cook etc. That is the hard reality whether you like it or even if you are hurt. I have seen PG BEd widow getting peon job double MA widow getting clerk's job.
Such jobs are given only out of 5% of Class III&IV posts (in direct recruitment quota) and comparative merit of the applicants is assessed. Remember reservation beyond 50% is not allowed as per Supreme Court guidelines. The Govt sector jobs are already reserved to the extent of 50% (15 SC+ 27 OBC + 7 ST). Therefore even that 5% is to be taken from the proportionately by vertical reservation from the respective share of Sc/ST/OBC/gen category posts depending upon the category of the applicant. That being the case the share if gen candidate is 5% of 50% = 2.5% out of total Class III&IV posts (in direct recruitment quota) , and OBC it is 5% of 27% = 1.25% out of total Class III&IV posts (in direct recruitment quota) , for SC 5% of 15% = .75% out of total Class III&IV posts (in direct recruitment quota) , and for ST it will be 5% of 7.5% = 38% out of total Class III&IV posts. No job can be offered beyond that limit even if the applicants are large number. The sots reserved for Handicapped, ex-servicemen and sports persons are also allocated in the same manner to ensure that horizontal reservation does not exceed 50%. So comparative merit is drawn based on the indignant condition of each family.

Compensate appointment are always made in class-III and class IV post. Hence I don't think you will get benefit of your educational qualification under this category of appointment.

Yes, as opined by the expert Kirti Kar Triathi in most of the State Governments are providing compassionate appoints to the dependents of the deceased in class-III and Colas-IV only. Even though you possess B.Tech (IT), compassionate appointment may not be provided to you to the post of Graduate Engineer. However, you may go through the compassionate appointment rules framed by the TAMILNADU GOVERNMENT.

I think department do not maintain list for such a long time. Your father had expired during 2008 and till March 2012, your application seeking compensatory appointment is under pipes so I am of the view that you should try to get employment at some other place proportionate to your qualification and should accept ex-gratia in liue of service.

I do not think that there is any provision of ex-gratia in lieu of job because job has not been given to you. Most of the states follow central patter, CG does not have any such provision. You may be luck if TN has such provision.
