my uncle want to transfer his property on his son name what title of document should be made whether DEED OF SETTLEMENT OR GIFT DEED, any difference in it pls clarify what will be suitable.
Dayananda Gowda (Expert) 25 December 2011
If the property is the self acquired property of your uncle, he may gift the property. If the property is joint family property, he has no right to gift the property. Gift deed is better.
Sailesh Kumar Shah (Expert) 25 December 2011
Gift deed subject to self acquired.
Advocate Bhartesh goyal (Expert) 25 December 2011
Yes if your uncle possess self acquired property then he should transfer the property to his all sons by way of gift deed and if property belongs to joint family then family settlement deed be executed.
prabhakar singh (Expert) 26 December 2011
In case your uncle is exclusive owner of the property he can simply gift it to his son as his son not having any kind of pre right in the property no question of settlement by surrender or relinquishment arises.

Rightly advised by Ld. Prabhakar Singh Ji.
