Querist : Anonymous (Querist) 15 November 2011 This query is : Resolved
A executed the Will in my favour . he died . i applied for probate and gave the name of "B " in the list of relations whom i believed to be the LR of A . The court granted probate in my favoour . Now after one year of probate "Y" is claiming to be the LR of 'A' . The 'Y' has given NOC inmy favour . Now am i the owner of the property as per probate or anything else is required t be done legally by me to become the owner of that property . I have been advised to file declaration suit . Will i have to make "B' as a party in declaration suit or only 'Y' will be made the only party in the declaration suit .

There is no need to file any suit as probate of will itself is a declaration. You get entered your name in concerned record of municipal authorities.
