3 year back i made an agreement eith my elder brother to sale my two roomed flat but he did pay me advance some money but did not paid any payment further.now he has sent me a notice to give me possesion or he will go for abritation (more over sale of aggrement is a notory public document.now iam not ready to sell him my flat any more.more over i,or he did not send any notice in this time lap.please advice me about this matter .sale agreement is not aregestired one

What was the time period fixed for the purchase of the property? Date of agreement of sale is necessary.

if entire consideration has not been paid how is he entitled to ownership and posession of flat? if the sale agreement is in respect of resale of flatin cooperative society no registartion is necessary . however you have strong case as purchaser has failed to pay entire consideration .
