the residents of a layout have paid one time maitenance charge for maintenance of flat-12no as per mofa act he was to hand over apartment to society but buider is not forming society and from one time maintenance charge he is manning whole town ship now is saying verbally that maintenace charge is for three years only though in agreement nothing is written we residents are demanding from buider to return the money taken from us as one time maintenance charge from us so that we can deposit the amount in bank as fixed deposit in fact as per mofa act the builder was to deposit the amount collected from us into bank as fix deposit but he did not do so and instead used our money what we residents should do as now he id demanding one lakhs as maintenance charge and we residents have told that since he ha already take one time maintenance charge from us we canot pay kindly gide us as to what legal remedy are available to us

isue legal notice and file criminal complaint against the builder for failure to form society within stipulated period from sale of flats .
you can also file complaint with the consumer forum for deficiency of service
engage a local lawyer .
