Removal of Mediator

Mediator was appointed on 06.04.2011 at the request of respondent husband's request. Till today no move from mediator. Respondent is fear that petitioner's advocate and meditor being good freinds delaying the mediation and saying that she has not received Court's order. When respondents enquired in the court, he came to know that order has been dispatched but mediator has not received the same. So Respondent wants to remove mediator and want to defend case as it is. Next hearing will be on 06.06.2011. If mediation is not done till 06.06.2011 can respondent request in the court to remove mediator and proceed the case.

If respondent is doubt on the mediator she may submit before the mediator only that she is not faith on the mediation. When one of the parties are not interested or faith on the mediator it is the duty of the mediator to return the case to the court stating the reasons.

Mediation mean its just am attempt to solve the matter amicable. Either by compromise or settlement. If any one not ready to believe on mediation mean very simple they can state that clearly to the mediator. Then he or she will send back the bundles to court.

And any words which is given before mediation will not be take to file to deciding the subject issues. So parties need not to worry about mediation
