Serving of Notice/ summons by court by Email.

Dear Experts,

Whether and when CPC was ammended making it legal for the court to serve any Notice or summons using E mail. I shall be thankful if any one can give detail, In a attrimonial case the groom has deserted the bride and court summons is to be issued at his foreign adress where he has become a citizen of that country.( He was citzen of foreign country when married india bride) I have to put up before the local family court for serving of summons by E- mail I am a jnior advocate.

Service of summons through e-mail is yet to be put in place in India.

I disagree. It has been recognised and approved by the amendment made to CPC in 2002. See Order V of CPC for further clarification which provides for service of notice and summons through e mail.

I am not sure what is the position of other states but at least in West Bengal it is still not the recognised and valid means of service of summons.

Apart from C.P.C, I would like to share my views with my learned brothers that after enactment and enforcement of Information Technology Act, 2002, Evidence Act has also been amended and provisions have been made therein relation to Information Technology Act. so Adv. Subramanium is correct.

Thank you experts for the guidance and valuable information. Now my enquiry reals that the facility of serving notice/summons has not been imlemented at Dist.level courts.
