Residential property paying commercial tax

Dear Sir/Madam
I want to open a clothing store on a property which is registered as residential but landlord is paying commercial tax. The property is in Pune and want to understand the legality of the same. The initial investment on setting the store is too high so little worried about it. Also taking indemnity will work in this case. Please advice so that I can close the deal ASAP.

Ask the land lord whether he obtained conversion of the user of the property for commercial purpose. Mere fact that he is paying taxes as for commercial premises would not have the effect of conversion.In the absence of such permission the PMC can prohibit u from running the shop in the premises.

If The residential property has not been converted to commercial, then on objection by neighbors and others, the authority may put seal to the commercial establishment proposed to be set up. Confirm the details and proceed.
