Gpf,pension,gratuity

one Govt. employee died leaving behind his wife, mother, son of an age of 20 years and daughter of an age of 18 years, now among all heirs who will get the pension at first or who will enjoy the amount of other facilities like GPF and Gratuity?

Pension to wife at first and after her death to the minor son/daughter. GPF and Gratuity to nominee, if any made by the deceased employee during her life time, otherwise to wife.

Nomination is treated like a WILL of deceased as held by hon'ble High Court n Supreme Court in several cases.

agreeing with Mr Vijayant Nigam I willa dd that wife does not lose her right even if not nominated as she cannot be excluded in nomination.


Wife will get entire amount of DCRG. PF, leave encashment, lasts pay due, pension commutation CGIES.


it is only after her death if the children have not started earning or not crossed prescribed age will get pension till limited period.
