i am working as regular employee under Punjab govt. I m facing a deptt inquiry for a false complaint against me. inquiry officer is acting under the influence of opposition. I have doubts regarding the facts against me, but inquiry officer is not providing me required information. I applied for information- copy of complaint, supporting evidence, copy of proceeding etc under rti act 2005 but he declined the demand under section 8 of rti act. what can I do now?

Dear Querist
file an appeal before appellate authority against this denial.
you have right to get all the documents.

In departmental inquiry copy of all the documents are to be provided to the delinquent employee and he is to be provided full and fair opportunity to defend himself. You can also take the assistance of some defense representative to defend you. If the same is not provided you may record the short comings in the inquiry proceedings in detail and also represent to the disciplinary authority accordingly.
There is no need to ask these through RTI. These are to be provided as procedure.

There was no need to file RTI application for the purpose of getting the relevant documents copy etc. on the part of the delinquent employee as the same is his legal right and if no such documents etc. are provided to him, he shall definitely gets its benefit in the departmental enquiry and subsequently in the court.

first of all while facing deptt inquiry you are entitled for the services of a serving/retired central/state govt employees.

facing inquiry like notice is damaging

you are notive that is the reason you filed RTI, while inquiry procedure itself makes it incumbent that the complaint be listed in chargesheet, copy to be provided and complainant to be brought for cross-examination. without this the punishment does not sustain.

I will partially disrgee with Mr Qureshi. Interlocutory orders of IO are not appealable.

But he can make bias petition and the feasibility of the same can be seen only if the papers are seen.

Inquiry Officer in a departmental inquiry is not supposed to provide you any document under RTI or tell you the name of the PIO and his appellate authority for the purpose of supply of information. As an Officer, you should be able to know who is the PIO or the appellate authority of your department. You can also know the names and addresses of the PIOs and the appellate authorities over them by opening website of your department. RTI is shown prominently on each department's website from which you can gather the needed information.
