dear sir, i want expert opinion on taxatiion of salary income of indian citizen taking job in forigen merchant ship crew ,salary is credit to his HDFC NRI A/c open at mumbai Branch.he is having NRI status from past three financial years.he files return in india as nil income as his salary income earned outside india being NRI. No return /TDS/Tax in any other country filled or paid by him in any years. what about whould be the implication of DTAA or any such law /regulation in his income and what he has to do now and in next years .

It is for the IT department to enquire whether he pays tax in some other country or not and whether he earns any income in India or not. It is not understood, what link do you have with the salary income of an NRI?

Dear Mr. Ashish Singh Narwariya,
The remuneration derived by a person in respect of an employment exercised aboard a ship or aircraft operated in international traffic, or aboard a boat engaged in inland waterways transport, may be taxed in the Contracting State in which the place of effective management of the enterprise which owns the ship is situated.
Since the country which is to tax the remuneration of a crew of a ship operating in international traffic is fixed as per the DTAA, the question of any double taxation in this regard would not at all arise.
In other words, only the Country in which the ship operating in the international traffic has been registered or having effective management, will tax the remuneration of the person employed in that ship.
