Form 240 of karnataka vat act

Querist : Anonymous (Querist) 31 October 2011 This query is : Resolved 
dear sir,
We have not filed form 240 for the f.y.2009/10 we have recived notice from vat office to pay penalty of rs 5000/- plus 50/- perday till now please tell me any judgement or act to avoid penalty.
