We are having ancesstoral property. My Grandfather transferred the same in the name of my father. My uncle (father brother) lives with my father & I am in service ,i live outside.I am afraid that if my uncle sells property which is in the name of my father without my presence.Or to control this situation I have to take a stay against that property so that my uncle dosnt sells that property without my consent.stay can be taken inhow many days.

If you have a smart advocate, you can get the stay in 24 hours.

I don't think the buyer of the property will be so foolish to puchase the property from your uncle, which is not in his name and is duly transferred in your father's name.

Also, suppose on some one agreeing to buy that property, your uncle would have sold the property before you get a stay order, what that stay will do for you? That may work even against you, as you would need to know the meaning of 'status quo' usually used by the court in granting any stay order.
