How to recover dues of Rs.15Lacs from client ?

We are a Delhi based traders of Gypsum product and on the berge of cheating by a Mumbai based interior contractors to whom we had supplied goods and have to recover over Rs.15lacs. We are cheated and when a lawyers notice was sent thay responded saying due to inferior quality material their payment is stuck so they can't pay. We understand from one of their ex. staff member that they are on cheating spree and have cheated several vendors.

Pl. help as to what we should do.

Better file civil suit for recovery of the amount.

You could several actions under civil and criminal proceedings like suit for recovery of money, summary suit, case for cheating, criminal breach of trust etc. Without knwoing the whole of the case details it would be difficult to pin point particular strategy.

since the amount involved is considerably high,better consult a lawyer locally and proceed on many options suggested by Barman.

If that ex-staff of the firm can help you get the particulars of other firms so cheated by hat firm. Contact those firms also to create proper evidence. This can provide mutual help to each other. After that file a case of criminal breach of trust by all in the courts of law at individual places of each of the party. Let them prove at what day and date the consignee firm informed you on receipt of he consignment about inferior product, and why they used that. This can help you to compel the firm to pay your dues.

Can we file cases here in Delhi as client is based in Mumbai and PO says subject to Mumbai Jurisdiction. Goods were supplied to their sites in North India only.
