fresh suit is maintainable to set aside a compromise decree on the ground fraud.? if yes ,but i lose the case in the sub-judge, and i appeal to the district judge, and my appeal was allowed , again the other party appeal the judgement to the the high court and his appeal is pending before the court . what will be the result ?

When the appeal is already preferred then it would be advisable to wait for the outcome of the appeal before filing a fresh suit.
