Hello Dear experts,
I am working in a central govt project on contract since 9 yrs, in the recent years due to shortfall of State govt employees, my department has deputed to State govt regular employee post. But last month due to my health condition I gone through cardiac stunt procedure. After discharge I joined duty and requested concern district officer to give exemption from deputed position for some period to recover myself, but he has not considered my request and not replied anything to me. Orally informed that it is not possible to remove deputation instead of that he asked me to go leave. I availed leave.
Now my query is
1. If any employee taken on contract for any position and is it possible to deputed him to another position without their concern?
2. If deputed is there any provision to employee to ask any kind of allowances ?
3. If deputed employee got sick is he have rights to ask to cancel that deputation or not?

It requires verifying the specific terms of your original contract, your deputation order, and the applicable rules for both central and state government services

Are you a permanent employee of State or Central goverment ?
Being a contract employee you cannot be deputed to work with some other department.

Deputation usually applies to regular government employees, where movement between departments is governed by service rules.
For Contractual Employees: Deputation is not automatic. A contractual employee’s service conditions are defined in their contract agreement / appointment order.
In practice, many departments “adjust” contract workers to other posts due to staff shortage, but legally, this should be with consent or with terms already covered in the contract.
Since you have a genuine medical condition (cardiac stent procedure), you have a right to seek relief.
That depends on department discretion, since contractual employees don’t have the same protections as regular staff.
If the officer refuses orally, you should make a written representation with your medical documents. Send it through proper channel, and keep a copy with acknowledgment.
You definitely have grounds to request cancellation/relief from deputation due to health reasons, but it is not an enforceable right unless supported by contract or specific service rules.

You have not been able to elaborate the conditions of service.

It is better to show relevant records to a local prudent lawyer for proper appreciation of facts, professional advise and necessary proceeding.

Why you are on contract employment for such a long period? Seek remedy for that issue.
