My father brought a house.we are 2 brother only.my father and brother expired.now my self amd my mother are alive and my brother wife and his son are also alive.now my brother wife want to left this house and want mutual settlement.can she has any right to sell share of his son .if yes there are need to get permission from court.how long time court will be taken .on what ground basis court give this judgement.my self isnot staying in that house due to job out of station and my brother wife also working in other place.

If you are hindu, your brother's family has the right over their share in the property even if they are residing in the property or not. They can claim the share even through the court.

Family of deceased son has share in the property of father.
Mother can sell minor son's share with the permission from court.
