Esic applicability etc

TT P.LTD IS A MANUFACTURING CONCERN IN PUNE HAVING 30 EMPLOYEES OF WHICH 10 ARE HAVING SALARY LESS THAN 15000
BUT THE COMPANY HAS TAKEN MEDICLAIM FOR ALL EMPLOYEES.
1)IS THE COMPANY REQUIRED TO TAKE ESIC REGISTRATION?
2)IF YES,WILL IT HAVE TO PAY ESIC CONTRIBUTION FOR THOSE EMPLOYEES HAVING SALARY LESS THAN 15000?
3) WILL THE COMPANY NOT BE EXEMPT FROM ESIC SINCE IT HAS MEDICALIM FOR ALL? IF EXEMPT,ANY FORMALITIES FOR TAKING EXEMPTION?

Yours is a factory employing more than 10 persons. As such u are required to register ur factory under the ACt with the ESIC. Contributions in respect all employees drawing wages of Rs.15000/- or less will have to be made as per the Act and the rules.Merely because medical insurance is taken for the employees ur factory will not be exempt from the provisions of the Act. For getting exemption from the ACt ur Factory will have to satisfy that u are extending to ur employees similar or superior benefits provided under the Act. In that case u have to apply to the Appropriate Govt for exemption which if granted will be notified in the Gazette.
