Respected Sir, 1)can a society chairman and treasurer call for the AGM of society without signature of secretary on notice of AGM. 2)can a audit be conducted/possible without signature of secretary on the balance sheet. 3)can a society cheques book be kept with treasurer or chairman and no a/c be submitted to secretary even no signature be obtained on vouchers also.also . Please help

If the constitution of the society permit so, they can proceed.

Thanks for your kind words sir. 1)The auditor has refused to do the audits of accounts for the period of 1st April 2014 to 31st March 2015 due to want of signature of society secretary but it seems that the chairman and treasurer are least bothered and have decided that they shall conduct the AGM on sunday 2nd August 2015 without any audits of the accounts. They have even not distributed the notice of agenda regarding the AGM to be held.They have put a notice just signed by the chairman stating that the AGM shall be conducted on 2nd August 2015. 2)Upon inquiry from the accountant it was mentioned that he was ordered by them to do so. 3)Is this allowed in COOPERATIVE housing society interests .

Secy is primcipal.office bearer of society. To conduct business he should be contacted or obtained his signature. Write to DDR that Chairman n Treasurer r exceeding their powers ignoring secy.

This Appears to be a gross violation to the rules and bye laws of the society. This can be taken up with the Registrar of societies for proper legal action against the erring office bearers.
