Vat issue on flat.

(Querist) 29 January 2014 This query is : Resolved 
Sir,
Builder had taken blank cheque and indemnity bond towards VAT amount and then gave me possession of flat.Now he had deposited my cheque in his account which got bounced on 31.12.2013. On 28.01.2014 his lawyer has sent a legal notice. Please advice me how to resolve this matter.

you have to reply to legal notice . contact a local lawyer . it should be your case that material alterations have been made in cheque without your consent . date , amount filled in by builder.

Mr.Sethi, Firstly let me thank you for prompt reply.

Sir, in 2007 builder and myself were not knowing the VAT amount so he took blank cheque and bond and gave me possession. Now he is claiming VAT amt.+interest from me.

Please guide me.Thanks.

Towards VAT liability you have given cheque and the indemnity. The builder may be under the obligation to pay VAT and he has adopted to present the cheque.

The builder has paid / to pay the VAT better pay the same and settle as it is your liability. If the builder has not paid and is not able to produce proof you may reply the notice.
