Service tax on rental income

(Querist) 21 November 2013 This query is : Resolved 
my father has given property on rent to bank.now his income exceeds the limit for rental income and therefore comes under service tax bracket.the agreement with the bank was signed about 8 years back and there is no mention of payment of service tax.now is my father entitled to claim service tax from the bank i.e user and pay it to the service tax department or is he supposed to pay from his own income my father is a senior citizen and a retired defence personnel has no other source of income except pension and rent

raise demand on bank to pay service tax . if bank refuses to pay your father would be liable to pay as agreement is silent regarding liability for payment of service tax
