Hi. I am architect. I had done a project in Mumbai of SRA. The society had given appointment in 1994 and the work started. While passing files I had to attach the society appointment letter.I did so. The file got approval in 2006 but construction didn't started now again the new file approval was done in 2011. Now the construction is in final stage. Now I sent a bill of my professional fees last year. Now they are saying its more etc. And they are not paying my fees. I further sent a letter for charging interest. Now through a nearby person, society people are started living in the flats without paying my fees. I hadnt given them CC and OC certificate.. I have informed the same to SRA authorities. But they are not taking any action.
Kindly help me. I want a lawyer. Kindly reply what should I do.

were your fees agreed upon in writing by the society?
if so issue legal notice to society then file a recovery suit against the society for recovery of your fees.

Yes. In society appointment letter it is mentioned that fees as per rules will be paid by developer.

what are the rules ? your fees ought to have been specifically mentioned . contact a local lawyer . necessary to go through the correspondence exchanged with society , the rules determining your fees etc

your cause of action is against the developer not the society . you fees were to be paid by developer

Yes. As per the rules the fees is 5% of construction cost.

this would be a grey area . what is the construction cost of the project . do you have the details . anyhow engage a local lawyer . you can afford legal fees .
