Want to get rid of my wife

Hi,

I got married last year in November and from the very first day my inlaws started interfering in my house and gradually things became worse.After two months my wife started asking me for divorce,in few instances she was at her parents house and on phone she started arguing with me on small things and used to ask for divorce.Before two months she went from my house by giving excuse that I she will be back in a week but after that she started asking for divorce over phone and she has laid 2 conditions in front of me 1)Either I buy my own house then she will come or else 2)she needs 15k per month from me as maintenance and she would be living at her parents house. Every fortnight she asks for divorce over phone and abuses me and threatens me that she will charge me in dowry case and will drag to the court.From the very begning after the marriage my parents have not been staying with me in Delhi and neither my all married sisters...only twice my parents have visited here to see how we are living..and now she is not ready to come to me unless I fulfill her demands and she is 8 month pregnant and says that she will not give my name to my coming child.I use to visit her once in a week and she creates scene every time. Please suggest me how I can get rid of her and can be safe of dowry case...I do not want to continue with her anymore as they have insulted me and my parents many times..once she also slapped my mother..when I complained this to my mother in law she said why don't you come to our place and live here..

My questions are

1)How can I get rid of her safely
2)If I shift to my native place and file RCR from there would that be a good step
3)Or should I give Talaq to her but what will be the consequences I will have to face then..

1. By mutual divorce.

Thanks for the reply but
1)She only says but never agrees for the divorce..she wants me to divorce her

2)What if I shift to my native place and file RCR and she comes and then files FIR that we are torturing her and beating her etc etc...

3)What will I have to plan to shift to my native place and what reasons should I produce in the court that due to such reasons I have changed the state..

4)If I tell her that I want to shift to my native place then she will not let me to shift..so If I move without telling her what legal games she can play with me..?

If you have to shift to you native place, how can we help to plan?

Your wife is not legally bound to be agree for the mutual consent divorce. If you have sufficient grounds then file divorce petition on those grounds and let the court decide it.

Dear Member with Deleted Account,

Factually, once marriage takes place there is no way to get rid of wife. My replies to your queries are as follows:

1) No safe way to get rid of her. Marriage is such a binding, you cannot get rid of her.

2) Change of place is not likely to help you. By your RCR, you would still be dropping your own idea to get rid of her. Any illegal means to get rid of her may prove to be quite costly for you and other members of your family disturbing your whole life.

3) Even if you take divorce (Talaq), you will still remain bound compulsorily with her for paying maintenance to her for life and for your coming child till he attains majority.

So, the midway is the 2nd option by making some compromise with her through RCR and to continue with compromising on several issues of discord till life. Please don't forget, discords always arise from time to time in married life.
