Not interested for ab

Guest (Querist) 26 July 2012 This query is : Resolved
In 498a case I am not interested for AB.
My wife is statying away from me since 5+ years.
I want to go for regular bail.
1. How many days it takes to get bail on the basis of regular bail?
2. What precaution one should take if he goes for regular bail?
3. Do police send some notice/summons before arresting?
Devajyoti Barman (Expert) 26 July 2012
1. It depends on court. Till the bail is granted you would be kept in custody which may extend to even 60 days.
2. It is suicidal if one goes for bail after making surrender instead of anticipatory bail.
3. In WB no.

Thanks Devajyoti ji.

But why it is suicidal if one goes for bail after making surrender instead of anticipatory bail?
prabhakar singh (Expert) 27 July 2012
Because before seeking regular bail one has to surrender on which one goes in judicial custody till the regular bail is not granted.
If bail is refused then one has to remain in jail.

A husband who is willing to jail for 10 to 15 days in matrimonial matters, will have upper hand in judicial proceedings and nothing can fear him. Once you are presented before the magistrate by the police within 24 hours of your arrest, you can move bail application there itself. It is the discretion of the magistrate to grant bail there itself or send you to judicial custody (police custody is rare in matrimonial matters)and generally after keeping a week or 10 days in judicial custody, husband will be granted bail.
