(Querist) 23 May 2012 This query is : Resolved 
costs imposed by court for not filing w/s, setting aside exparte evidence at my request amounts toRS. 2300/ IN TOTAL. THESE were not depositedand case decided exparte. now to file an appeal ag orders is it must to deposit such costs.

no need to file any appeal, you can file an application before the court to waived off the cost, the court may wived off the cost.

You can file appeal challenging the ex-parte Order of lower court without remitting the costs imposed. If the cost imposed on your petitions and if you had agreed to remit the cost, it is better to approach the lower court on remitting the cost and praying to set-aside the ex-parte Order. In such cases, otherwise, the decision of the Appellate court also may not be favourable to you, who disobeyed the order awarding cost.
