Transfer of property

Dear Sir,

I had purchased a commercial property in year 2004 from a lady (vendor) and registered local register office. Unfortunately, mutation in municipal records is delayed from my end.

when I approached municipality for mutation, it is identified that property tax bill on vendors husband.
and no proofs in municipality how vendors husband name in records.

Municipal person suggested toget no objection on Rs 50 bond paper from Vendors husband.

When i approached vendor, they are demanding money for signing.
Is they have legal rights to demand money?
Shall I loose my legal rights, if property tax bill on others name?

The following documents are with me.

1. Registered sale deed on my name
2. Link documents
3. EC on my name
4. Electricity bills on my name
5. All property tax original bills.
but paid on vendors husband name.

Kindly suggest and help me, right way of procedure to sort this issue.

I am sure there must have been a covenant on your regd. sale deed - as to vendor doing all that he can to effectuate complete transfer to you - Send them a legal notice - if they fail to comply, file a suit for SP on the basis of implicit contract to co-operate in mutation

There might be a term in the sale deed that the vendor is responsible for all municipal and other taxes till the day of execution of the sale deed and buyer shall be responsible thereafter. If there is any arrears pertaining to past period, it is the responsibility of vendor so you should issue a legal notice to vendor in case he is demanding the extra money for that purpose with a copy to municipal authorities. If still vendor is not ready, file a civil suit against both.
