Dear Sir,
Please let me want to know that, if Husband or Wife will claim for Divorce first, which is preferable.

No body gets any preference at all only because he files the case for divorce first.

Law on divorce makes no discrimination in this aspect.

You can file a suit jointly on Mutual Consent Divorce or any spouse can file a suit for Divorce on contest in Family or District Court.There are some provision of laws to file a Divorce suit,you should contact with a Lawyer.

As per as law no pereference is given on the basis of filing divorce first. It totally depends upon the facts and evidences of the case. It is better to file a mutual consented divorce

Though I reckon sometimes people see advantage of first mover in other cases, by taking defences, I abhor any such efforts, the court also sees the same and hence, the mental benefit sometimes becomes a liability.
