there is a locker in a bank containing alot of gold ornaments, one of the brothers may be the younger one, appeals that he has been using the locker since so many years and it belongs to him. There are three brothers and a sister ... in the lower court the judgement was in favour of the younger brother. in that judgement the court held that some of the property to be divided equally. but not the locker ... please tell me a solution

The locker is whose name as per the bank record? What are the evidence regarding the ornaments ? Yes as per the judgement the property of your parents are divided equally, in that judgement what are the things being indicated and mentioned. if those jwells are also mentioned then you all entitled for the same.

Sir,
The bank account is in the name of the father .. who is no more now . And there is a commission report which actually found what are the ornaments inside, and one more thing is, there were rifles which were divided equally amongst the right holders, but not the locker, the case was in lower courts since 2005. and now the elder brother , sister, and one in the middle are ready to fight against the youngest..

File an appeal against the judgement of lower court.

I guess there is no judgement as yet. Fight case on merits.

Let's file an appeal against the lower court judgement. As the judgement is vague

anyone nominee of locker?

file appeal against judgement.
Raj Kumar Makkad (Expert) 14 November 2011
Shah! Locker was handled by youngest son as told to us in facts so there is no relevance of nominee.

If youngest son was authorized by his father to handle locker on his behalf then the material found therein certainly shall belong to his father and if youngest has put any his own jewellery therein, it is purely on his risk so all legal heirs are its owners. You have no other option but to file an appeal.
