Sir,
I have booked a ticket from IRCTC on line for my nephew. I filed TDR as my nephew preponed his journey from Pinakini Express starting on 25/01/11 to 24/01/11 by night train with out reservation as he has to attend work at chennai on 25/01 @11am.I filed TDR on 26/01/11 as chart is prepared by 12.15am 0n 25/01/11.my claim is dishonoured after 8months 15 days

you had booked your railway ticket on 23/1for train journey starting on 25/1 . if booking has been done you are supposed to travel on that date or cancel your ticket immediatedly in case you do not desire to travel . you did not do so .
whether in the final passenger chart prepared by railways for 25/1 your name is shown on list of confirmed passengers?
or RAC?
it appears railways have rejected your claim as you did not travel on said date nor did you cancel your ticket

Dear Mr. Ramanarao,
Please have some heart before posting such queries.
The train 12711 leaves Vijayawada at 06.00 hrs. and reaches its destination Chennai at 13.00 hrs. covering a distance of 431 Kms.
Your son had a confirmed reservation for 25.1.2011. Had he travelled he would have reached Chennai on the same day at 13.00 hrs.
According to Railway refund rules, “Refund of fare shall be made after deducting cancellation charge from the fare (i) If the ticket is presented for cancellation within four hours before the scheduled departure of the train and up to Six hours, when the ticket is for a destination station of more than 200 KM but up to 500 KM.”
According to you, you have filed the TDR on 26.1.2011, nearly 18 hours after the train had reached the destination!
Therefore, the Railways are well within their rights in rejecting the refund claim. YOU DO NOT HAVE ANY CASE AT ALL.

Sir,
I did in correct way if you see the attached file you will find facts. I did 2 reservations one for my sister by Satavahana Express leaving Vijayawada on 25/01/1911 and another my sister son by pinakini Express .
Both have preponed their journeys . My sister got reservation as enior citizen(quota) on 24/01/11 by Masulipatam express and my nephew travelled by GT or Tamilnadu Express after he boarded train he confirmed. Incidentally both the tickets canceled by me byfiling TDR on 26/01/2011. As per railways they will allow to file TDR only after that train reaches destination .
Here my sisters TDR claim dt 26/01/11 settled on 1/2/11 .
This on account of TTE not reporting a list of non travelled persons.
Not on account delay in filing TDR.For online E tickets we have file TDR only . we can not do it across counter.
So please help me

Your sister's train 12709 leaves vijayawada at 1.30 a.m. and reaches the destination at 7.45 a.m. The distance was 644 Kms.
According to railway refund rules (c) If the ticket is presented for cancellation within four hours before the scheduled departure of the train and up to Twelve hours, when the ticket is for a destination station of more than 500 KM., refund would be available.
You had time upto 1.30 p.m. on 26.1.2011 to file TDR in respect of your sister's ticket and probably you might have filed within that time. That's why you got the refund. Whereas as already indicated, you had filed the TDR in respect of your nephew after at least 18 hours.

Distance between Vijayawada to Secundrabad is no 644 kms Journey period is 6.15 minutes. ie I have Filed TDR and claimed it after 30 hrs. The E tickets cancellation rules are different
• Cancellation of e-Tickets after the preparation of Reservation charts:
For Normal User:- E-ticket cannot be cancelled after chart preparation. Users are requested to use the online TDR filing for such cases and track Status of the refund case through tracking service provided by IRCTC. Such claims can be filed from next date from the journey date to 30 days from the date of journey. For filing online TDR , select the ""File TDR"" Link in the left panel under the ""My Transactions"" Menu. For additional information regarding TDR, Select the ""File TDR Procedure"" in the left panel under the ""General"" Menu. IRCTC will forward the claim to Concerned Railways to process the refund and money of refund amount will be credited back to same account
So your presumption not applicable here.
The TTE did not submit the report as per his duty guide lines It is for Railways to ask his explanation why he did not report

If you suppose you are correct,lodge a compliant of compensation before appropriate forum after serving 2months notice of demand in case notice remains unheeded ,that is the way you can sail.

Sir,
in fact I sent a reminder on 8/9/11 to IRCTC and asked them to settle my claim before 26/9/11 (by that time it is 8 months old.I have also asked them who is next person/authority to whom I submit my Grivience. I also indicated I will seek lgal form.
later i have received a reply as per that they are saying it is used ticket. As I know the full facts I will ask my advocate to file a case in consumer forum. Which Form I have file my native place Vijayawada or Deciding area Chennai or IRCTC Newdelhi. It is not question of money it is about rights of consumers

IRCTC New Delhi, would be best,if in Vijayawada IRCTC does not have any office.
