Mutation of land not done even if builder has been paid for it.

(Querist) 30 August 2011 This query is : Resolved 
a residential plot has been purchsed in ranchi after full payment to builder. The registry has been done but mutation of plot has not been done by builder in favour of purchaser even if he has been paid in full including registry and mutation charges for it through cash & cheques. Receipt of payment is held with purchaser but the builder is not getting mutation done even after repeated reminders. Suggest legal course of action for either compelling him for mutation or refund of money.

You serve him through a legal notice followed by a civil suit for injunction.

a flat is being purchased in delhi under partnership by two individuals each paying half of money under POA. Both the parties want to entera mutual agreement in respect of this so that it can be sold with mutual consent only in future. Right now allotment of flat through poa will be in name of one party only. What should be the prequisites/essential safeguards of such a partenering agreement. I s such an agreement neef registration or it's admissible if it is notarised only?
