Respected Sir/Madam,
One of our relative had taken purchased the flats from a builder, the agreement stated he would complete the construction and handover the property. We had paid lumsump of Rs 20 lakhs in total.
Now we have been made aware that the builder has been arrested on ground on cheating and misleading the citizens on promises of selling flats and Villas.
I want to know the procedure to file the case against the person.
As per the recent article on news paper these promoters were arrested and let on bail. We had been to police station to know the status, they has adviced us that the case will be filed once the time period for number of owners filing the case is complete.
How can we know whether the case has been filed against the person.
If we want to file a case what are the procedures involved please advice me

you first confirmed that the builder is ready to construct the flat or not, if he is not willing to do so, then file criminal and civil cases against the builders.even what are the cases going on him.

file case aginst builder before the consumer forum after issue of legal notice as he has failed to handover posession in time . you can also claim compensation

Expert : ajay sethi has suggested less expensive effective course of consumer fora against an expensive civil suit but Expert : M.Sheik Mohammed Ali is also right for suggesting criminal cases against the builder.

I think you are not sure about waht type of cases have been filed against the builder and what grounds and by whom. First of all confirm that your builder has cheated you . If he has done so, You can go for the remedies suggested above by Expert Ajay Sethi and Expert : M Sheik Mohammed Ali
