CAN MINORS SUE

(Querist) 28 June 2011 This query is : Resolved 
can the sons aged 11 and 13 yrs file a suit in court against mother for neglecting them and abandoning them and requesting the court to come back home? The mother left them to suffer one month before their final exams. They did not have proper food and were living alone at home as the father had to go to work. The family returned only last year from abroad to settle in India and the sons cannot speak the local language. PLEASE ADVISE

as per law, depends upon the situation can suit minor to the court, otherwise POA can suit on behalf them.

Yes. Minor can sue. But on behalf of them the natural guardian or the next friend only can enter in legal proceedings.

Minor can sue but for that natural guardian or the next friend must be appointed .
It depend upon the facts as the mother only neglect for exam period now if it continue then you can take legal action .

If father is there as natural guardian what is the necessary or the circumstance to sue?
In other events, the minor can sue.
