Regarding My Father WILL

Querist : Anonymous (Querist) 22 March 2011 This query is : Resolved 
My Father has written a Will before the his Death.

He mention that if my mother expired before his death the whole property should come to me .

Else

If my mother is still alive then She Shall be entitled to enjoy as a sole beneficiary and Universal legacy of this will till her death.

My syster took my mother and kept in her house.
I went to court and brought injection : Not to elinate property.

My mother had written another will stating that after her death the whole property should go to my syster.


So far i my father not given even 1 paisa to me .


Will i get Property by any chance ?

Since you state that according to the WILL, your mother will be the absolute owner of the property, she has every right to deal with it in whichever way that she wants. If she gives the property by way of WILL to her daughter (i.e. your sister), you can do nothing about it. Of course, you can lay challenge to the WILL on the ground of fraud, undue influence, pressure, coercion etc., It is for the Court to decide whether your challenge is valid or not based on the defence that would be put up by your sister.
