LE Suit in Small Cause Court

Querist : Anonymous (Querist) 18 November 2010 This query is : Resolved
Issues have been filed in this case, but I do not know what are the issues. It is very important that the following issues be framed
1. " Does plaintiff prove that he is the owner and landlord of the suit property?
2. Whether plaintiff proves that he is recognized as owner of suit property, by the Cooperative society i.e. in this case the society where he is staying along with his brothers.

Can new issue be framed if these issues have not been framed?
Thanks
Worried and bullied

If issues not yet framed then court can frame the issues on the basis of the plaint and written statement pleadings.

My brother who has filed the LE suit has now filed an appeal before the Registrar asking that he be made a member of the coop society where we live. The Society had refused his application for membership because there is a nomination in the name of all 4 brothers (as HUF)
He is trying to prove that he is owner ( if he is made member? How should I fight to protect my interests? tha I am also co-owner. Should I also appear before the registrar and raise objections.
