Yes, but the accused has got the right to move the bail application u0s437 crpc in the court of the Magistrate itself where he is first produced. So there is no such provision for moving bail application u/s437 crpc. Only for anticipatory bail u/s 438 or for bail u/s 439 crpc the application lies to the Sessions court or the high court.

All bail applications must start from lowest level except for special courts but there also first to that court than higher court.
