INDIAN PENAL CODE

(Querist) 29 October 2010 This query is : Resolved
WHAT ARE THE SECTIONS UNDER IPC IN WHICH A PERSON ARRESTED HAS TO MOVE BAIL PETITION DIRECTLY TO DISTRICT OR HIGH COURT BUT NOT IN ANY MAGISTRATE COURT.
s.subramanian (Expert) 29 October 2010
Se.302 IPC and other offences exclusively triable by the Sessions court.
Devajyoti Barman (Expert) 29 October 2010
Yes, but the accused has got the right to move the bail application u0s437 crpc in the court of the Magistrate itself where he is first produced. So there is no such provision for moving bail application u/s437 crpc. Only for anticipatory bail u/s 438 or for bail u/s 439 crpc the application lies to the Sessions court or the high court.
DEFENSE ADVOCATE.-firmaction@g (Expert) 29 October 2010
All bail applications must start from lowest level except for special courts but there also first to that court than higher court.
Sri Vijayan.A (Expert) 04 November 2010
I agree with Mr.Barman
