Hello Sir/madam theres a person who tortures his wife and inlaws.he doesnt even behave properly with his children.he has been married for 22 yrs nw.how can we sue him on terms of domestic violence and he always took money from the lady's parents, but there is no proof of it being dowry.what are the possible ways of filing a case against him and getting divorce as soon as possible. Will the testimony by his children(two of them who are majors now) regarding his abusive nature be sufficient to prove it.?What legal action can be taken against him.and how can the lady and her family be protected? Please reply at your earliest convenience. Thank you.

The lady can lodge complaint u/s 498A IPC or file case under Domestic Violence Act. The evidence of the children will be taken into account.

Agreeing with the suggestion of devjyoti, I suggest you not to be worry as two of the sons of such person have become major and they may mend successfully the ways of their cruel father by their own ways.
I think this is the best time of suffering wife has started now. She should rule the house now with the help of her two sons and even should not allow her husband to enter therein with malafide intention.

Thank you so much Mr.Devajyoti,Mr.Raj Kumar.. The problem is that the only son who is a major is away from home pursuing his studies. The other two children are daughters and one of them is away from home studying too.Only the eldest daughter who is 21 years old stays in the house. So we are worried that if we complain to the police that man might get violent and do something to the Lady and her daughter. The lady has no brothers or elders in her family who can stand up to him. Would it help approaching a Women's group for support and protection. And also the person who I talked about is a government officer and has a lot of influence in the local Police. So it seems like a completely hopeless situation.!
