matrimonial dispute

(Querist) 18 September 2010 This query is : Resolved

respected sirs,

can i get more informations on exparte-divorce, what is meant by exparte-certificate or evidence?how can i furnish it if necessary?then how much time it will take the court to grant the divorce decree?
Devajyoti Barman (Expert) 18 September 2010
Ex parte order means when the court pass any order hearing only one side of the case. If the other side in spite of service of summons fails to appear in the case, the court passes ex parte order.
If the court fixes the ex parte hearing then the petitioner is asked to adduce ex parte evidence.
The time depends upon lot of factors including completion of service of summons.
adv. rajeev ( rajoo ) (Expert) 18 September 2010
even after service of summons to the respondant he failed to appear before the court on the date fixed for the apperance, on that day he/she will called out and he/she will be placed ex-parte and after the petitioner's evidence petition will be allowed that is called as exparte divorce. if you led the evidence on the day when it is fixed for the evidence next step will be for the argument and next will be the judgement.
Sri Vijayan.A (Expert) 19 September 2010
This procedure applicable for all the Ex-Parte orders and not only to divorce
