Transfer of Flat by Gift

(Querist) 31 July 2010 This query is : Resolved 
A & B real brother jointly own falt in registered co-op soc. Mr A transfer his share by Gift to Mr B. and approched to society for transfer. But society does not have any document for the said flat in the record of the society and Mr A or Mr B also does not have any document accept Duplicate Share certificate. Now please suggest how society can transfer the said flat in the name Mr B?

The gift of immovable property or a share therein can only be effected through a registered gift deed. In Maharashtra stamp duty at reduced rate of 2% on gift of immovable property by relative is levied.

Your query is entirely theoretical.It is impossible that the co-op soc.do not have any records relating to possession of flats & shares.

How its possible without any parent document.. Then how a and b got ownership.? Your query is not clear friend..
