with whom the possession of the rented premises is vested, if the tenancy agreement is drafted as a Licence

In the case of lease the possession remains with the tenant whereas in the case of licence it remains with the owner. The nature of the agreement depends on the contents thereof irrespective of the nomenclature. So merely because it is styled as licence it does not become a licence.
